EPC Contractor Direct Agreement
Project Document
An EPC Contractor Direct Agreement creates a direct contractual relationship between the EPC contractor and the representative of the project lenders. It requires direct notice before specified termination, suspension or insolvency-related action, gives funders a protected period to cure or intervene, and supports continuation or transfer of the EPC Contract during project-company distress. Its focus is preservation of construction completion: the works, site, design, materials, performance security, subcontract chain and the practical ability of a replacement entity to finish the project.
