Income Tax Act
The Income Tax Act is Kenya's principal statute for taxation of income, including business profits, employment and investment income, withholding obligations and the tax treatment of cross-border and related-party arrangements. It is a frequently amended principal law and must be read as at the relevant transaction and accounting period.

What This Instrument Does
It defines taxable income and persons, establishes charging and computational rules, provides deductions and capital allowances, regulates withholding and instalment obligations, and contains international and anti-avoidance rules. Administration, returns, assessments, objections and collection are substantially governed by the Tax Procedures Act.
Why It Matters
Project economics depend on the tax treatment of construction, operations, financing, shareholder returns, asset depreciation and payments to contractors or non-residents. Tax assumptions in a financial model must match the current consolidated law, the project's facts and any properly available incentive; this page cannot substitute for transaction-specific tax advice.
