Law & Regulation
Real Estate Transaction Tax Law
The Law establishes the Real Estate Transaction Tax (RETT) framework for taxable disposals and other covered real-estate transactions. It defines the tax event and liability architecture and supports exemptions, valuation, reporting, collection and enforcement through the operative rules. It is a Tax record, not a Land Law record. Its interaction with land transactions is transactional and should not create additional topic coverage.
Legal Significance
What This Instrument Does
The Law imposes tax on transactions falling within the statutory concept of real-estate disposal, identifies responsible persons and compliance duties, and provides authority for exemptions, valuation safeguards and enforcement. The application to shares, reorganisations or project transfers must follow the exact statutory and implementing conditions rather than economic analogy.
Why It Matters
Infrastructure development may require land acquisition, lease/right restructuring, asset transfers, corporate reorganisations or enforcement. RETT can affect transaction cost and completion mechanics, and an exemption may depend on exact facts, holding periods or procedural compliance.
