Registered Real Estate Mortgage Law

The Law establishes the framework for registered mortgage security over real estate. It governs the mortgage relationship, registration, secured debt, priority, dealing with the property and realization within the Saudi land and enforcement systems. It must be applied with the registration regime applicable to the parcel. It is complementary to the Commercial Pledge Law and should not be treated as its real-estate chapter.

  • Mortgageable real estate/right

    Defines the permissible subject matter. Transaction relevance: not every site right or concession is necessarily mortgageable.

  • Secured obligation

    Links mortgage to a debt/obligation. Transaction relevance: affects future, contingent and amended facility coverage.

  • Mortgagor possession/use

  • Transfer of debt or property

    Regulates effect of assignment/disposal. Transaction relevance: relevant to refinancing, loan transfer and asset sale.

  • Protection against impairment

    Provides remedies where collateral value is threatened. Transaction relevance: interfaces with maintenance and insurance covenants.

  • Enforcement and sale

    Channels realization through applicable enforcement process. Transaction relevance: contractual self-help assumptions must match mandatory procedure.

  • Release and discharge

    Ends registered security when conditions are met. Transaction relevance: required for repayment, refinancing and title cleanup.
