Electricity Regulation Amendment Act 38 of 2024

Amends the Electricity Regulation Act 4 of 2006 to restructure South Africa's electricity market: provides for a Transmission System Operator (TSO) to perform transmission, system-operation, market-operation and central-purchasing-agency functions (s34A), with the National Transmission Company South Africa (NTCSA) performing the TSO role on a transitional basis subject to NERSA approval (s35C). Substantive provisions commenced 1 January 2025 (Proclamation 236 of 2024, Government Gazette 51778); the section 1 definitional amendments to "reticulation" and "distribution power systems" remain held back for a further proclamation not confirmed commenced by the research cut-off — consistent with, and cross-checked against, the authoritative Full V2 ZA-L-061 record.

Key Provisions

  • Section 34A — Transmission System Operator

    Establishes the TSO to perform transmission, system-operation, market-operation and central-purchasing-agency functions.

  • Section 35C — Transitional arrangement (NTCSA)

    From the Act's effective date, the NTCSA assumes the TSO's role subject to NERSA approval, with the TSO required to be legally established within five years of enactment. Practical consequence: for generation, trading and network projects, this determines who performs system-operator and market-operator functions during the transition.

  • Section 1 definitional amendments ("reticulation", "distribution power systems") — not yet commenced

    Excluded from the 1 January 2025 commencement; require a separate Presidential proclamation not confirmed as commenced by the research cut-off. Practical consequence: municipal electricity-distribution and reticulation rights and boundaries remain governed by the pre-amendment position at the research cut-off.
