Law & Regulation
Turkish Civil Code
Co-primary security statute governing real-estate mortgages and pledges over shares, receivables and other rights, and the residual law for movable pledges.
Legal Significance
What This Instrument Does
Governs real-estate pledges: mortgage, mortgage-backed note and annuity note (Art. 850 et seq.). Covers possessory pledges of movables (Art. 939) and pledges of transferable receivables and other rights, including shares (Arts. 954–955). Applies wherever Law No. 6750 is silent.
Why It Matters
Real-estate mortgages and share pledges are core project-finance security classes in Türkiye, so the Civil Code is a co-primary security instrument alongside Law No. 6750 rather than a supporting one.
